Why Seek an Attorney

If contemplating filing a personal injury lawsuit or wrongful death case for a car accident, you should consult with your attorney. Florida is a no-fault based state. This means that your own PIP insurance is responsible for the first 10,000.00 in medical bills. Only if you have suffered a permanent bodily harm can you seek damages from the at fault party.
However, prior to accepting a settlement agreement with and insurance company, be sure to speak with your attorney regarding your case.

What Compensation Will You Receive?

When the insurance company refuses to pay the damages, you need to recover after a life-altering car accident, an attorney can help you recoup those losses in court.
Some examples of the damages you can recover in a personal injury or wrongful death claim include loss of wages, medical costs, future earnings, property damage repairs, pain and suffering, and emotional distress.

What is the Reason for So Many Accidents?

  • Driving while intoxicated (i.e., alcohol, illegal substances, or prescription drugs)

● Distracted driving (i.e., texting or talking on the phone)

● Reckless driving (i.e., illegal maneuvers, tailgating, speeding)

● Other factors (i.e., weather conditions, unfamiliar roads and highways)

How Often Do Car Accidents Happen?

According to the Florida’s Integrated Report Exchange System (FIRES), there were over 60,000 car accidents recorded in the state of Florida in 2017. About one-third of which resulted in injuries, and 270 of which were fatal.

WHAT ARE THE MOST COMMON INJURIES THAT OCCUR?

Injuries resulting from a car accident can vary from person to person. Some common injuries might include back and neck injuries, spinal cord injuries, broken and fractured bones, cuts and bruises, and brain injuries.

What Should You Do If You Are in an Accident?

In the state of Florida, it is a crime to leave the scene of an accident. So, if ever you are involved in one, immediately pull over to the side of the road or a safe area. Check on the other drivers and passengers and then call 911. Take photos and video of any damages to your car or injuries sustained. Be sure to keep records of any property damage repairs and or medical bills and other expenses you incur. Note that there is a 4-year statute of limitations to file a lawsuit for injuries sustained in a car accident.
